Are you looking for a secure international investment that, in addition to capital appreciation, opens the door to official residency status in a country with a stable democracy?
Investing in foreign real estate is a natural step for Czech investors seeking to diversify their wealth. In this regard, Costa Rica offers truly exceptional conditions. It combines long-term political stability, a high quality of life, a modern healthcare system, and a welcoming legal framework that allows foreign investors to obtain temporary residency, permanent residency, and full citizenship.
As a native Costa Rican with professional experience at the Embassy of the Republic of Costa Rica in Prague, I frequently encounter situations where investors make critical procedural errors right at the outset of purchasing property. In this article, I provide a detailed breakdown of the legal requirements, the exact application process, tax and customs incentives, and the essential financial transfer rules without which Costa Rican authorities will not grant residency status.
WHO THIS ARTICLE IS FOR
This analysis is intended primarily for investors who:
- are considering purchasing residential or commercial property in Costa Rica valued at USD 150,000 or more
- want to secure temporary or permanent residency for themselves and their family in a safe and politically stable country
- plan to take advantage of statutory tax incentives and customs duty exemptions applicable to investor assets
- want to avoid hazardous legal mistakes made by unauthorised intermediaries and execute the transaction strictly in accordance with Costa Rican law.

1. WHY INVEST IN COSTA RICA REAL ESTATE
Costa Rica has long been recognised as one of the most stable democracies in Latin America. Foreign investors particularly value:
- Political and economic stability: The country has no standing army, invests heavily in education and infrastructure, and maintains a transparent legal system that protects private property rights.
- Quality of life and healthcare: Access to first-rate medical care, a pleasant tropical climate, and extraordinary natural wealth make the country a sought-after destination for living and long-term stays.
- Strong demand: A dynamically expanding tourism sector and sustained interest from the international community create ongoing opportunities for real estate investment and other key industries.
2. TEMPORARY RESIDENCY THROUGH INVESTMENT (RESIDENCIA PARA INVERSIONISTA)
One of the most common pathways to legal residency in the country is the category known as "Residencia para Inversionista" (Investor Residency). Under Costa Rican immigration law, foreign investors qualify for temporary residency by investing a minimum of USD 150,000 in the country.
This capital may be directed into real estate purchases, commercial enterprises, reforestation projects, or shares in Costa Rican companies. A fundamental condition is that the investment must have an up-to-date, verifiable value that can be thoroughly documented before Costa Rican authorities.
To apply for temporary residency, applicants must submit:
- a completed temporary residency application form, submitted directly to the immigration authority
- complete documentation verifying the USD 150,000 investment value (purchase contracts, wire transfer receipts, and Costa Rican bank statements)
- a criminal record certificate from the Czech Republic, apostilled and issued within the past six months
- an apostilled birth certificate for the applicant, also issued within the past six months
- proof of payment for the statutory application fees (in both USD and colones) deposited into the designated account at Banco de Costa Rica (BCR)
- passport photographs and a biometric fingerprint registration form
- consular registration for Czech citizens to establish an official record of residency applicants.
3. TAX, LEGAL, AND CUSTOMS INCENTIVES FOR INVESTORS
The Costa Rican state actively encourages foreign capital. An approved temporary investor residency status includes an attractive package of incentives:
- Import duty exoneration: Residents receive a one-time customs duty exemption on the importation of personal effects, household appliances, and furnishings, covering both new and used items.
- Duty-free import of up to two vehicles: Investors may import up to two vehicles for personal use duty-free, whether land, maritime, or air transport. In the event of loss or theft, the law permits importing a replacement vehicle under the same terms.
- Income tax exemption: Investors who properly declare their investment income as part of their residency application are exempt from income tax on that revenue.
- Reduced property transfer fees: The law grants a 20 percent exoneration on real estate transfer taxes and fees for properties acquired while holding investor residency status.

4. PATH TO PERMANENT RESIDENCY AND COSTA RICAN CITIZENSHIP
Temporary residency is the first milestone in a comprehensive immigration process that can ultimately lead to full citizenship.
- Permanent residency (after 3 years): After three consecutive years of holding temporary residency, an investor is eligible to apply for permanent residency. This status provides unrestricted residence rights and does not require a minimum number of physical days spent in Costa Rica each year.
- Costa Rican citizenship (after 7 years): Following seven years of permanent residency, investors may apply for Costa Rican citizenship. This grants full civil rights, including voting privileges and unrestricted business operations. Furthermore, Costa Rica fully permits dual citizenship, allowing Czech investors to retain their original Czech citizenship and passport without issue.
"Investing in real estate in Costa Rica is an elegant and straightforward route to legal residency in a stable country. However, the vital prerequisite is that the entire transaction must be carried out strictly according to Costa Rican law. Any attempt to route payments outside the local banking system can permanently derail your immigration plans."

5. CRUCIAL WARNING: THE INVESTMENT MUST BE MADE DIRECTLY IN COSTA RICA
This is the most critical stage of the entire process, and one where many Czech buyers make serious errors. By law, payments for real estate purchases must be executed directly within Costa Rica through Costa Rican banks or authorised financial institutions.
Brokers in the Czech market occasionally offer buyers the option to transfer funds for Costa Rican property to a domestic Czech bank account. Doing so exposes you to significant risk. Under the Costa Rican General Immigration and Aliens Act and the Investment Act, all payments must be processed within the Costa Rican financial system to qualify as an eligible investment for residency and tax benefits.
Transferring funds outside the Costa Rican banking system leads to severe consequences:
- Rejection of the residency application: The immigration department will not recognise the investment as official and will dismiss your residency petition.
- Loss of tax and customs incentives: You will forfeit all statutory benefits, including duty-free vehicle and household imports as well as transfer tax reductions.
- Severe legal complications: The property title may not be correctly recorded in your direct ownership within the Costa Rican National Registry, creating critical obstacles for future sales, rentals, or ongoing asset management.
6. THE CORRECT AND SECURE PURCHASE PROCEDURE
To ensure the transaction proceeds smoothly and the authorities fully recognise your claims, you should follow this established procedure:
- Route payments exclusively through Costa Rican banks: Every financial transaction must be officially recorded and declared within the Costa Rican banking sector.
- Maintain thorough documentation: Keep all bank statements, contracts, proof of transfers, and title registration certificates. These materials are mandatory components of your residency application.
- Work with vetted local professionals: Every transaction should be overseen by a certified Costa Rican notary and an attorney specialising in immigration and real estate law.
